2010 deadline fast approaching, Farmers must comply also

04-22-2010

The EPA Nov 2010 deadline for all petroleum ASTs with a cumulative capacity of 1,320 gallons or more is fast approaching. All SPCC plans must be updated and implemented by this date.

Farmers are not exempt from the EPA rule and must comply with the regulations. Many farmers may be able self certify their SPCC plans versus hiring an engineer to complete the SPCC Plan. Farmers who have more than 1,320 cummulative gallons of oil products on their farm should go to the web site listed below for more information. Crop spray oil is not included in the oils that must be in the SPCC Plan.

Farmers will not be "grandfathered in" concerning compliance to this federal EPA regulation. If a farmer has above ground storage tank(s) with more than 1,320 cumulative gallons of oil products on the farm then they must follow the regulation. All containers 55 gallons or larger must be included in the SPCC Plan. SPCC Plans includes secondary containment.

This compliance is part of the Clean Water Act of 1973 that in now being enforced.
